Torrence Brown Jr was not injured in the shooting spree, but his close friend AJ Boik was shot in the chest and later died. Brown has said that he is suffering from emotional trauma from the incident.
Brown later hired lawyer Donald Karpel with an eye to sue the Century 16 movie theatre, shooter Holmes's doctors and Warner Bros, reports TMZ.
The attorney claims that Century 16 showed neglect by not having emergency exits guarded and also accuses Holmes's doctors of not properly treating the suspect. Holmes apparently had been on various medications at the time of the shooting.
Brown's legal team also insists that Warner Bros is partly responsible as well because of the violent content in the Batman films.
"Somebody has to be responsible for the rampant violence that is shown today," Brown's lawyer Karpel said.
If Brown does pursue the suit, it will be the legal action filed in the wake of the shooting.
Suspect Holmes made his first court appearance on Monday (July 23), but has not yet been formally charged. He will return to court next Monday (July 30).
It was also reported that a decision on pursuing the death penalty against Holmes might not be made for 60 days.
